aPEX Wellness Group — Coaching Agreement

(Web-Based Agreement — Effective Upon Checkout)

1. Overview

This Coaching Agreement (“Agreement”) outlines the terms and conditions between Apex Wellness Group (“Coach”) and the individual purchasing coaching services (“Client”). By completing a purchase of any coaching service, the Client acknowledges that they have read, understood, and agreed to the terms below.

This Agreement applies to all coaching tiers, including but not limited to:

  • Performance Coaching Plus

  • Remote Performance & Wellness Coaching

  • Coaching‑Guided 40‑Day Metabolic Reset

  • Any future coaching tiers or coaching‑supported programs

Specific features, communication frequency, and support levels vary by coaching tier and are described on the product page for each service.

2. Nature of Coaching Services

Apex Wellness Group provides remote performance, wellness, and lifestyle coaching. Coaching may include:

  • Training program design

  • Lifestyle and habit guidance

  • Video review

  • Check‑ins (weekly, bi‑weekly, or monthly depending on tier)

  • Education and general wellness support

Coaching is not medical care, physical therapy, chiropractic care, or any form of diagnosis or treatment. Coaching is educational and performance‑oriented in nature.

3. Payment Terms

3.1 Monthly Recurring Services

The following services renew each month automatically until canceled by the Client:

  • Performance Coaching Plus

  • Remote Performance & Wellness Coaching

The Client authorizes recurring monthly charges at the listed rate.

3.2 Paid‑In‑Full Services

The following services are paid in full at the time of purchase:

  • Coaching‑Guided 40‑Day Metabolic Reset

  • Self‑Guided 40‑Day Metabolic Reset

  • Any retail or commerce products (e.g., supplements, accessories, GolfForever units)

Paid‑in‑full services are non‑recurring.

4. Refund Policy

Refunds are available within 72 hours of purchase, only if coaching has not started.

Coaching is considered “started” when:

  • The Coach sends the Client their onboarding message, regardless of whether the Client responds.

After coaching has started, no refunds are provided under any circumstances.

5. Communication Expectations

5.1 Response Times

  • The Coach will respond to messages within 24 hours during business hours.

  • Business hours are Monday–Friday, 7am–7pm EST.

  • Saturday responses may occur at the Coach’s discretion.

  • The Coach is not obligated to respond on Sundays or holidays.

5.2 Communication Priority

Response priority is as follows:

  1. Performance Coaching Plus

  2. Coaching‑Guided Reset

  3. Remote Performance & Wellness Coaching

5.3 Communication Channels

Coaching communication may occur through:

  • Email

  • Trainerize app

  • In‑app messaging

  • Video review tools

Text messaging is not an official communication channel.

6. Program Delivery Timeline

Training programs and onboarding materials will be delivered within 3–5 business days after purchase and completion of intake materials.

7. Missed Check‑Ins

If the Client does not complete a scheduled check‑in:

  • The Coach will still deliver a progressed program.

  • Personalization may be limited due to a lack of updated information.

  • The Client understands that missed check‑ins reduce the effectiveness of coaching.

This is standard practice and ensures the Client continues receiving value for their subscription.

8. Client Responsibilities

To maintain an effective coaching relationship, the Client agrees to:

  • Provide honest and accurate information in all intake forms

  • Disclose injuries, limitations, or relevant health information

  • Follow the program to the best of their ability

  • Ask questions when unclear

  • Submit check‑ins on time

  • Respond to Coach inquiries within a reasonable timeframe

  • Maintain access to email and the Trainerize app

  • Keep the app updated and functional

  • Upload videos when requested

  • Notify the Coach of schedule changes or issues affecting training

Failure to meet these responsibilities may result in immediate termination of coaching without refund.

9. Termination Policy

Apex Wellness Group reserves the right to terminate coaching at any time, without refund, if:

  • The Client becomes uncoachable

  • The Client violates expectations or boundaries

  • The Client engages in disrespectful or inappropriate behavior

  • The Client fails to meet the responsibilities listed above

  • The Coach determines that the relationship is no longer productive

This protects the integrity of the coaching environment.

10. No Guarantees

The Client understands that:

  • Results vary based on effort, consistency, and adherence

  • The Coach cannot guarantee specific outcomes

  • The Client is responsible for their own effort and follow‑through

11. Assumption of Risk

The Client acknowledges that:

  • Physical activity carries inherent risk

  • They are voluntarily choosing to participate

  • They are responsible for exercising within their abilities

  • They should consult a medical professional as needed

This section is reinforced in the separate Liability Waiver / Informed Consent.

12. Agreement Acceptance

By purchasing any coaching service, the Client acknowledges that they have:

  • Read this Agreement in full

  • Understood the terms

  • Agreed to be bound by them

Checking the required box on the product form constitutes legal acceptance.
